Brad Moscato

Brad’s practice sits at the intersection of disability and employment law – two areas that frequently overlap when an employee becomes disabled, their benefits are denied, and their employment is subsequently terminated. He handles the full spectrum of disability claims: group LTD denials and cut-offs, PTSD and veterans’ disability cases, chronic pain and fatigue claims, mental health disability, and the growing category of Long COVID claims where insurers dispute benefits on the basis of insufficient objective medical evidence.

From 2015 to 2018, Brad served as Chair of the Ontario Trial Lawyers Association’s Long Term Disability Section – the most senior leadership role in Ontario’s plaintiff-side LTD bar. In that capacity, he helped shape advocacy, education, and professional standards for disability lawyers across the province. He has presented on LTD strategy, examination for discovery of insurance adjusters, the medicine behind disability law, and Long COVID claims at conferences organized by the OTLA, OBA, Canadian Bar Association, Canadian Society of Medical Evaluators, Canadian Institute, and the Advocates’ Society.

Brad’s background is unusual among personal injury lawyers: he studied Journalism at Niagara College before completing a BA in Political Science (Honours) at Brock University and an LLB at Osgoode Hall Law School. His communications background shows in the clarity of his client communications, his written advocacy, and his ability to explain complex medical and insurance issues to judges, arbitrators, and juries.
